This website is operated by Rex Rarities. Throughout the site, the terms “we”, “us” and “our” refer to Rex Rarities. Rex Rarities offers this website, including all information, tools and services available from this site to you, the user, contingent upon your acceptance of all terms, conditions, policies and notices stated herein. 
By visiting our site and/or purchasing from us, you agree to be bound by the terms and conditions as stated herein. These terms and conditions apply to all users of the site. 

Please read these terms and conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these terms and conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or purchase from us.

Any new features or tools which are added to the current store shall also be subject to the terms and conditions. You can review the most current version of the terms and conditions at any time on this page. We reserve the right to update, change or replace any part of these terms and conditions by posting updates and/or changes to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

Payment
All prices displayed on our website are in U.S. currency. We accept payment via credit card, PayPal, cashier's check, personal check, money order, or bank wire transfer. For payments made via personal check, we will always wait until the payment has cleared before shipping the item. When you agree to purchase an item from us, you do so guaranteeing that you will make payment promptly and in full, unless allowed otherwise and in writing by Rex Rarities. Rex Rarities retains title to all items until payment for them has been received in full.

Please note that we are required by law to file IRS Form 8300 for cash transactions totalling more than $10,000 for a single transaction (or for more than one transaction made within a 24-hour span), for payments made over the course of up to one year following the date of the original transaction.

We reserve the right to charge a 1.5% late payment fee per month for payments not completed within one month after the date of sale, unless otherwise agreed upon in writing. For sales with significantly past-due payments, we reserve the right to take legal action against the purchaser at our discretion. In these cases, the purchaser agrees to pay all related attorney's fees and legal costs incurred by Rex Rarities in enforcing this policy. However, we would much rather not do this and would rather resolve things on a friendly basis, so please try to communicate any issues with payment to us in advance.

Taxes
All items delivered to or at a location within the State of New York are subject to both state and local taxes, unless we are provided with a verifiable and current resale certificate and a signed ST-120 form. Please contact us at info@rexrarities.com to provide us with this information if applicable. New York State taxes are charged at a rate of 4%, while local taxes are charged at a rate ranging from 3% to 4.875%, meaning the total tax rate for deliveries in New York will range from 7% to 8.875% depending on the address. 

Following the recent South Dakota vs. Wayfair decision, we are currently not required to charge sales tax for deliveries into other states due to the "small seller exception", but this may change in the future.

Shipping and Insurance
All items shipped by Rex Rarities are inclusive of tracking and insurance and require a signature confirmation when shipped to addresses within the United States. We bear any risk of loss on shipments within the United States until the shipping carrier has confirmed delivery of the shipment. When shipped internationally, items are inclusive of insurance only when it is possible to acquire a signature confirmation through the standard mailing services. When the point of delivery does not allow for signature confirmation, the buyer bears all risk of loss, and we are not liable for any loss or damage incurred during shipment. In these cases we always will contact you via email before shipping your purchase out to you, to confirm that you would still like to proceed.

All prices are inclusive of shipping charges for items delivered in the United States, unless expedited services are requested. Items will be shipped without charge via USPS Priority Mail for all shipments under $2,500 in value, and via FedEx for all shipments above $2,500 in value. If you would prefer to use USPS for shipments above $2,500 in value, we must ship via USPS Express Mail and an additional fee will be charged based on the shipping cost. If you would prefer to use FedEx for shipments under $2,500 in value, an additional fee will be charged based on the shipping cost.

We maintain that we will follow the rules and regulations of proper exportation of shipments from the United States and will declare all shipments at their full customs value for all international shipments. However, we are not to be held liable or responsible for the circumvention of these rules by our customers without our knowledge, should they do so with items that they have purchased from us and after the transfer of title.

Condition
All coins sold by Rex Rarities are graded and authenticated by either PCGS (Professional Coin Grading Service) or NGC (Numismatic Guaranty Corporation) unless otherwise specified. Coins encapsulated in holders by either of these two companies are given either a numerical grade or non-numerical "details" grade denoting their condition. Please note that these grades are by nature opinions and therefore subjective. 
Additionally, all descriptive language used by Rex Rarities to illustrate the appearance of our items is subjective; we are heavily focused on the aesthetic, historical, and technical appeal of the coins we offer, and their "appeal" as such is by nature subjective. Therefore, we make no guarantees as to the grade, quality, or provenance of items we sell, save that they are currently encapsulated and graded by either PCGS or NGC with the grade we have noted. However, all items certified by PCGS or NGC are subject to the respective guarantees of PCGS and NGC, which allow for their reimbursement to the buyer of the value of the coin in the event that they deem it overgraded or unauthentic.

Additionally, we make no guarantees as to the future liquidity or lack thereof of items that we sell. Liquidity in the rare coin market can fluctuate widely and is heavily based upon demand. We do our best to price our coins based on what we believe is fair given their grade, condition, rarity, appearance, quality, historical significance, provenance, distinctiveness, and eye appeal. Nonetheless, due to the lack of guaranteed liquidity in the rare coin market, we do not advise purchasing our coins (or anyone's, for that matter) with long-term investment in mind, but rather for either a short-term resale or better yet as a permanent addition to your collection. We strive to provide coins that are specifically curated to the satisfaction of buyers who desire a wonderful new addition that will set their collection apart.

Authenticity
All coins are unconditionally guaranteed by Rex Rarities to be genuine and authentic. Coins certified by third-party graders are no longer subject to this guarantee if they are removed from their slabs. Please contact us at info@rexrarities.com with any concerns about authenticity.

Returns 
Any item purchased from Rex Rarities is subject to a full refund for any reason if we are notified within seven (7) days of receipt. All shipping fees are non-refundable. If more than seven (7) days have passed since the delivery of the purchased item at your shipping address, unfortunately we cannot offer you a refund for your item, except at our sole discretion and with our written approval. Returns must be shipped back to us within twelve (12) days of receipt. We require proof of purchase for all refunds. Please notify us at info@rexrarities.com before proceeding with any and all returns.

Items purchased from Rex Rarities may be eligible for a return only if their condition has not been altered from the state in which the buyer received them; for example, if an item is received in a certified plastic "slab" from a third-party grading service such as PCGS or NGC, it must not be removed from the slab and the slab must not be subjected to additional damage in order for it to be eligible for a return. If we receive the item back in a significantly altered state, as described above, we reserve the right to refuse a refund or subtract fees from the refund as necessary for services such as reholder fees. In instances in which we refuse a refund, we will ship the item back to the buyer at no additional charge.

We do not purchase shipping or provide insurance for return shipments on behalf of the buyer; buyers are responsible for shipping and fully insuring any items they return us, and we are not liable for any loss or damage incurred to returned items during their transport to us. As we do not provide shipping or insurance for returns, you may consider using a trackable shipping service and purchasing shipping insurance. We do not guarantee that we will receive your returned item.

We reserve the right to refuse orders from customers who have returned a significant number of purchases from us in the past.

Any exceptions to the above polices are valid only at the sole discretion of, and with the written approval of, Rex Rarities.

Refunds
Once your return is received and inspected at our location, we will notify you and issue your refund. Refunds are to be issued using the same method of payment that was used by the buyer to complete the purchase; however, we reserve the right to refund all payments in U.S. Dollars.

Layaways
To purchase an item on layaway, please email us at info@rexrarities.com to discuss terms. Generally we will require a portion of the purchase price as an immediate down payment, with the remainder split over a agreed-upon length of time. Items purchased on layaway are not eligible for returns or refunds. Rex Rarities retains physical possession and title to all items from layaway agreements until the purchase is paid in full. Cancellation of layaway orders is subject to a fee of 8% of the value of the purchase. If layaway orders are not paid in full and on time, we reserve the right to cancel them and refund the buyer the full value excluding the 8% fee. Please be sure to contact us if you need an extension of your terms.

Selling to Us
If you have an item that you think may be of interest to us, you are welcome to send us images of the item and your asking price to info@rexrarities.com. For items certified by PCGS or NGC, please be sure to include the certification number.
